Apple Being Sued Over iCloud Trademark by iCloud Communications
Well, it appears there already is an existing iCloud out there–iCloud Communications. They’re not happy over the use of iCloud and in turn are suing Apple, according to TNW.
The goods and services with which Apple intends to use the “iCloud†mark are identical to or closely related to the goods and services that have been offered by iCloud Communications under the iCloud Marks since its formation in 2005.  However, due to the worldwide media coverage given to and generated by Apple’s announcement of its “iCloud†services and the ensuing saturation advertising campaign pursued by Apple, the media and the general public have quickly come to associate the mark “iCloud†with Apple, rather than iCloud Communications.
Essentially the company wants Apple to cease the use of the name iCloud entirely. iCloud Communications specializes in VoIP solutions for small to medium-sized businesses. It’ll be interesting how Apple will respond to this one.

when a company uses “iSomething” they are already demonstrating that
they have no imagination and are trying to ride the coat tails of Apple.. Apple
has been using the “iWhatever” naming convention for a lot longer
than just 2005. I’m no apple fanboy I assure you but in this case I would most
certainly find in favour of Apple. “iCloud” really doesn’t say
“Small IT Company that provides VOIP services to other small businesses”
to me, no more than calling it “Rainbows and Unicorns Communications”

I’m guessing that iCloud will cash in nicely……they just hit the lottery as Apple usually won’t capitulate on something like this and will either buy the name or buy the company outright a la Microsoft/Skype. Future iOS feature I’m guessing and then they won’t need to worry about Skype being compatible with iOS anymore…….plus it would be a “poke in the eye” to Microsoft…….something that Apple relishes.
Regardless of what you think if iCloud own/trademarked the name Apple has no choice but to offer compensation (for damages if iCloud goes that route), offer to purchase the name/company, or abandon the name altogether. Naming a company in an effort “to ride the coat tails of Apple” is irrelevant in a court of law it’s who can prove ownership/copyright/trademark of the name first that will ultimately decide the court’s ruling.

Cooool … The iMac is 13 years old though … And even if they by chance did not start it (which they did) they made it popular enough that companies like this one try to ride their success.
