Apple Wins Suit Against Samsung, Bans Galaxy Smartphone Sales In Europe

AppleInsider has just reported that Apple has apparently won the suit against Samsung which was filed for Apple design patents violation, leading to a ban in sales of Samsung Galaxy smartphones in European Union. These handsets include Samsung Galaxy S, Samsung Galaxy S II and Samsung Ace. The ruling came from a court in Netherlands, according to the news source, located in the city of The Hague, which is set to take effect around mid-October and does not include Samsung Galaxy branded tablets.

Florian Mueller from FOSS Patents writes:

“In legal terms, the order does not bind Samsung’s Korean parent company — only three different Samsung subsidiaries registered in the Netherlands — with respect to other countries than the Netherlands,”

“However, it is my understanding that Samsung’s European logistics use the Netherlands as the primary hub. If Samsung’s Korean parent company wants to exercise its freedom to ship into other European countries despite this injunction, it will have to reorganize its logistics chain in Europe accordingly.”

This is yet another major win for Apple in the ongoing “battle of patents” with Samsung, after already having won a similar patients violation suit against Samsung Galaxy Tab 10.1 in Australia few weeks back!

What do you think guys, is Apple heading in the right direction here or is it being a little bit too aggressive? Could this move affect Apple’s future ties with Samsung, the major supplier of displays for its best-selling iOS devices?

I’d love for someone to make a list of the countries this includes or doesn’t include because the patent has expired for one reason or another.

Apple is no long the “cool” company ! The reason I come to this site, because it’s great info for carrier
specials. Jobs is nothing but a dictator giving the users what _he_ wants, not what the users want.
i had an iPhone for 3 yrs, but tired of the restrictions. i read the articles of all Job followers on flash.
What a joke ! Sure maybe HTML 5 is better, but there’s no winding down of flash on the web. I now
have a Galaxy S2 and it blows the iPhone 4 away. The iPhone 5 may catch up to it hardware wise, but
i’m sure it will still have all those restrictions. Pretty well everything is configurable on the S2 without
having to “jailbreak” it (even though you can “root” the phone if you wish). It has flash, folders, just drop
in an .avi, .mkv. etc and it plays ….like a smartphone should be.  Jobs doesn’t like competition, so he
letigates…..

Theres only so many ways you can design a full touch screen phone. Most of them all look the same now a days. How apple won this is beyond me. They obviously feel threatened by Samsung for them to have gone through with this.

Clearly the courts see that Apples patent was violated … The phones may all look similar but companies still have rights based on their patents … If they don’t want another company ‘mimicking’ their product without permission or compensation their fully within their rights to challenge … That’s capitalism.

They only infringed on one patent, the way the photo gallery works you iFan. A simple update will fix this and the ban will never even take effect. This is actually a win for Android as all others including Tablet suits were dismissed.

is already behind. If you get a chance to try an S2 you won’t look back. Compared to Jobs phoney, the S2
is like a small computer, they way it should be. No need to convert .avi, etc to Apples format, just drop in.
I’ve always hated how iTunes works, i can just drop my tunes in, folders and all, and away i go. The phone
is so much more configurable without having to “jailbreak” the device

Looking into this, it’s not really a big deal for Samsung …too bad Apple !
Two of the three patent infringing allegations were thrown out. The one
that stuck is Samsungs Gallery app, they just have to change that and
they’ll be good to go.

Ok let start by saying “give me an iPhone over a galaxy S2 any day. I own both. I gave the galaxy a shot and gave it to my wife. It hangs and glitches and hiccups more than the iPhone. Also I am not loyal to one brand or another. It’s just that my experience with the iPhone has been better. Also the diversity of apps and the like are better with the iPhone. But the real point here is that everyone is doing their best to copy apple and catch up. Apple torpedoed the smartphone market. Power to apple for defending their patents. Would you not do the same if it was your patent being infringed on?

Also I am not loyal to one brand or another. It’s just that my experience with the iPhone has been better. Also the diversity of apps and the like are better with the iPhone. Matter of opinion, but sounds to me like you got a bad S2 and should return it.
I’ve had mine for over a month now, i’m a heavy user and have it loaded up
with apps and it has never “hanged”, “hiccuped” on me, it has worked perfectly
for me since day one. Multitasking is better, no lag whatsoever, did i mention flash,
it works great …has always been a big peeve of mine with the iPhone. Same with
not being able to pop off the cover to replace the battery, or insert extra storage
like on the S2.  Sure, the iPhone has more than the 250,000 apps Android has, but
how many flashlight apps do you need ? 🙂 Seriously, there is only 1 app i couldn’t
find i’d like to have that was on my iPhone ….again, of course depending what
you’re looking for. Apple’s “patents” are questionable IMHO, can go back to the
Xerox days… but that’s another story. The S2 hasn’t reached the US market yet, but
otherwise internationally, the S2 is outselling the iPhone. The iPhone could be a
great phone, but Jobs decided to brain damage it. With the S2 hitting the market
in the US, Jobs better realize he’s no longer “God” and open iPhone if he doesn’t
want to start losing market share

As far as jobs is concerned I mentioned I have no loyalty. I made no claim to which is the “better product”. I stated I will take the iPhone over the s2. I don’t understand how they can rule for apple, they’re just a bunch of hackers and lucky that in asia they can’t sue a company in the west
