Apple and Samsung Submit Lists of Patent Claims and Infringed Products for Next Trial

Before they sit down to hold court-mediated meetings, Apple and Samsung are preparing for a second round of major patent litigation, which will kick off on March 31. They have filed the final list of patents and products they are accusing each other of infringing, Foss Patents reports.

Last year both parties were forced to meet certain limits on the number of patents and products asserted. They have semi-voluntarily dropped two patents each, and back in September provided a list of five patents each. Yesterday evening, however, the parties notified the court, as well as and each other, of the final list, which we will provide below. As the court invalidated a Samsung patent, it will have only four, whereas Apple brings five patents to court:

U.S. Patent No. 5,946,647: (“data tapping” patent) “System and method for performing an action on a structure in computer-generated data” (Claim 9)
U.S. Patent No. 6,847,959: (Siri-style unified-search patent) for “Universal interface for retrieval of information in a computer system” (claim 25)
U.S. Patent No. 7,761,414: for Asynchronous data synchronization amongst devices (claim 20)
U.S. Patent No. 8,046,721: for “Unlocking a device by performing gestures on an unlock image” (claim 8)
U.S. Patent No. 8,074,172: (auto-complete) for “Method, system, and graphical user interface for providing word recommendations” (claim 18)

Samsung’s asserted patents and patent claims:
U.S. Patent No. 7,756,087: for “Method and apparatus for performing non-scheduled transmission in a mobile communication system for supporting an enhanced uplink data channel” (claim 10)
U.S. Patent No. 7,551,596: for “Method and apparatus for signaling control information of uplink packet data service in mobile communication system” (claim 13)
U.S. Patent No. 6,226,449: for “Apparatus for recording and reproducing digital image and speech” claim 27
U.S. Patent No. 5,579,239: for “Remote video transmission system” (claims 1 and 15)

As Florian Müller of Foss Patent notes, the products listed above for the 2014 trial will be from 2012 and previously because of the slow US patent litigation system. But the list is relevant to two distinct remedies: damages and injunctive relief.

Also, it is worth noting here that the anonymous request to re-examine Apple’s ‘172 auto-complete patent was granted by the USPTO last August, Müller has learned. This is important to Apple, because the next big lawsuit will include that patent, and specially claim 18.
