Apple Denied Permanent Sales Ban on Samsung Products

FOSS Patents reports Judge Judy Koh has come down with two important post-trial decisions in the ongoing Apple versus Samsung patent war saga. Apple’s permanent sales ban on infringing Samsung products has been denied (these were products the jury decided infringed on Apple’s patents). According to the court order (via The Verge):

In sum, to the limited extent that Apple has been able to show that any of its harms were caused by Samsung’s illegal conduct (in this case, only trade dress dilution), Apple has not established that the equities support an injunction. Accordingly, Apple’s motion for a permanent injunction is DENIED.

The second decision by Judge Koh denied Samsung a new trial over allegations jury foreman Velvin Hogan failed to disclose he was part of a lawsuit against Seagate (which Samsung eventually became an investor in the latter). Judge Koh blamed Samsung’s legal team for failing to exercise their due diligence, as Hogan clearly noted he had worked with Seagate during the process to select the jury. As for Hogan’s post-trial comments that Samsung alleged unfairly persuaded the jury, Judge Koh dismissed that argument too.
