Trump Vows Decision on TikTok Ban as Supreme Court Upholds Ruling

In a unanimous decision, the U.S. Supreme Court has upheld a federal law mandating the divestiture of TikTok’s U.S. operations by its Chinese parent company, ByteDance, by January 19, or face a nationwide ban (via Bloomberg).

The Court’s ruling emphasizes the government’s apprehension regarding national security, particularly the potential for the Chinese government to access sensitive data of American users through TikTok.

With the January 19 deadline imminent, TikTok’s future in the U.S. remains uncertain. The platform, which boasts 170 million American users, may be compelled to cease operations if ByteDance does not secure a sale to a U.S.-based entity. This scenario would also prevent Apple and Google from offering TikTok on their app stores.

President-elect Donald Trump, set to assume office on January 20, has indicated a willingness to address the situation. In a social media post, he stated, “My decision on TikTok will be made in the not too distant future, but I must have time to review the situation.”

The outgoing Biden administration has opted not to enforce the ban, leaving the decision to the incoming administration. Reports suggest that President-elect Trump may consider delaying the ban’s implementation for up to 90 days if a sale is near completion.

Meanwhile, ByteDance has consistently resisted the notion of selling its U.S. operations. However, the looming ban may prompt a reassessment. The company has pursued legal avenues to challenge the law, arguing that it infringes upon free speech rights. Nonetheless, the Supreme Court dismissed these claims, asserting that the national security risks take precedence.

This development is part of a broader scrutiny of TikTok in the U.S. due to its Chinese ownership. In 2020, the U.S. Army and Navy banned the app on government devices, citing security risks. Additionally, several states have enacted similar bans for government employees.
